A clear understanding of the often complex law and legislation involved is required. It is advisable to consider the assistance of a patent attorney to manage the patent.

To maintain the legal protection your patent provides, you must:

  • pay annual renewal fees
  • notify the ISIPO if you wish to amend your patent details, e.g. a change of address, a change of ownership or licensing arrangements.

The ISIPO will not enforce the patent for the owner. It is the owner's responsibility to:

  • protect the patent against infringement and take action if he finds out it is being copied or used without his permission
  • consider international rights.

Annual renewal  fees

Annual renewal fees must be paid on your patents if you want them to remain in force. It is up to you to pay them on time.

The cost will vary depending on the type of patent and the number of years that have passed since you originally filed it. These fees are usually due on or before the anniversary of the filing date of your complete application.

You start paying renewal fees on the second anniversary of the filing date, paying annual fees for the first three years. Renewal fees are then due each anniversary after that until the patent ceases.

The first payment of annual renewal fees is on the second anniversary of the filing date. 

You can view your patent in the patent search to check the date on which your renewal fee is due.

One option to ensure the renewal fee is paid on time is to arrange for an annuity firm or a patent attorney to keep track of the due date and forward your payment to us.

To change ownership of a patent, please complete the change of ownership form and send the request to the email address isipo@isipo.is along with evidence supporting the change in ownership. This could be a deed of assignment or a signed company sale/purchase agreement, for example.

Payment information will be sent back to the requestor. Amendment fee is according to the price list.

Once the change of ownership has been validated by the ISIPO, it is possible to request a new certificate of registration that shows the patent under the name of the new owner. 

Assignment form

To change an address or edit a name on patent, a request must be sent to the email address isipo@isipo.is. The request must include: 

  1. The previous address
  2. The new address

Payment information will be sent back to the requestor. Amendment fee is according to the price list

Registered patents can be licensed through a contract. It is advisable to seek legal advice when drafting a contract. The Icelandic Intellectual Property Office does not assist in the drafting of contracts between parties, nor does it provide forms for the licensing of patents.

To change or add an agent on a patent, a request must be sent to the email address: isipo@isipo.is
If changing an agent, the request must include: 

  1. The previous agent, including full address and contact information 
  2. The new agent, including full address and contact information
