Renew a design

Design registration lasts for a period of five years from the filing date of the registration and may be renewed upon payment of a fee for four subsequent periods of five years, resulting in a total period of registration of twenty-five years. Renewal fees are payable on the 5th-, 10th-, 15th- and 20th-year anniversaries of the date of registration. If registration is not renewed, the design will cease.

To keep the design in force it must be renewed three months before or six months after its renewal due date. Renewals can only be submitted for designs that have been granted and have not yet lapsed.

If a design is copied

Please advise the other party that you have a registered design and ask them to stop the action you see as infringing your copyright. If they do not stop, you may have to consider taking legal action. It is recommended to seek professional legal advice before threatening any legal action. The designer is responsible for monitoring the way your designs are used and protecting them against infringement. The Icelandic Intellectual Property Office is not able to provide assistance if design copyright is infringed.

To change ownership of a design, please complete the change of ownership form and send the request to the email address: isipo@isipo.is along with evidence supporting the change in ownership. This could be a deed of assignment or a signed company sale/purchase agreement, for example.

Once the change of ownership has been validated by the ISIPO, it is possible to request a new certificate of registration that shows the design under the name of the new owner.

To change an address or edit a name on design, a request must be sent to the email address isipo@isipo.is. The request must include: 

  1. The previous address
  2. The new address

Registered designs can be licensed through a contract. It is recommended to seek legal advice when drafting a contract. The Icelandic Intellectual Property Office does not assist in the drafting of contracts between parties, nor does it provide forms for the licensing of designs.

To change or add an agent on design, a request must be sent to the email address: isipo@isipo.is.

If changing an agent, the request must include: 

  1. The previous agent, including full address and contact information 
  2. The new agent, including full address and contact information

It is not possible to change a registered design, but is possible to request to delete images.

Request to cancel a registered design can be made at any time. The request must be sent to the email address isipo@isipo.is.

If a design has licensees or mortgagees it is important to provide documentary evidence with an agreement of the cancellation of the design. Once a design is cancelled, it is not possible to reinstate the design's previous status. All rights attached to the design, conferred through the application, will be immediately relinquished.

Prior to registration, it is possible to request that the registration of a design be deferred. It is also possible to change the registration deferment date of an application ready for registration. 

The period of grace provides the designer with the option of making a design public, including testing it in the market, within 12 months prior to deciding whether an application shall be submitted to the Icelandic Intellectual Property Office. The publication of a design, at the behest of the designer, within these time limits does not have an effect on the novelty of the design.

It is safest to submit an application as soon as the design is fully formulated and before looking for investors or possible manufacturing partners. However, an application may be submitted up to 12 months after a design was made available without this curtailing its novelty.

An application created by a division must not be wider than the original application and the new application may not cover the same images as the original application. A partition request may not be accepted if it is unclear whether the partition fits within the original application. Once the request for division has been processed, the new application receives a new independent application number but retains the same application date and priority date as the original application that is available for distribution.

The request must include:

  1. The number of the application to be divided
  2. A list of what should be divided e.g. category

If a design is not renewed three months before or six months after its renewal due date, the rights of the design will lapse. 

If an observation is made on an application, a two months deadline is given to respond. If no responses are received, the application will be abandoned.

It is possible to restore a lapsed/abandoned design by applying for restoration and showing that the failure to pay a renewal fee/respond to the examination report was unintentional.

If restoration is requested beyond 12 months of the lapsed/abandoned date, is also required to provide evidence to show that there was no undue delay in applying for the restoration.

Once a design is withdrawn, it is not possible to reinstate the design’s previous status.

An owner or an agent for a registered design can request for a copy of a certificate of registration. This may be useful if a design has recently changed ownership, or has had any updated information that would be reflected in its certificate. The regenerated certificate of registration will reflect a design as it is currently recorded in the register.
